Your Mortgage
During divorce, property is usually divided giving one spouse sole ownership of the family home, and full responsibility for repayment of the mortgage.
It is important that the spouse who takes the home be ordered to refinance the home as soon as it is reasonable to do so because it is usually the case that both couples are individually responsible for the repayment of the mortgage. If payment is not timely and complete, the spouse not getting the home needs to be able to hold the other responsible, as the mortgage company could try to collect from either one.
