If you do not have a pre-nup (or matrimonial agreement) it is highly likely that the property you acquired during the marriage was community. There are a variety of ways to divide this property.
You can do this consensually, but for this approach it is often best to wait until after divorce if you do not have to wait too long to get a divorce. If a divorce is too distant, you can divide the property while still married.
If there is no agreement on how the property is divided, after both sides itemize the property, a court will divide the property. Again, this can happen both while waiting for or after divorce.
